LEGAL REQUIREMENTS FOR DIGITAL ACCESSIBILITY

Starting on June 28, 2025, all businesses within the EU — both public and, to some extent, private sector companies — will be required to make their digital offerings accessible to everyone. This regulation is based on the EU Directive on the Accessibility of Websites and Mobile Applications, which is part of the European Accessibility Act (EAA).

In Germany, this will be implemented through the Barrier-Free Strengthening Act (BFSG). Businesses, such as e-commerce sites, must design their websites and mobile apps in a way that ensures they are accessible to as many people as possible, regardless of impairments. These requirements are based on the Web Content Accessibility Guidelines (WCAG 2.2), which serve as the standard for digital accessibility. Failure to comply can result in legal consequences, including warnings and potential sanctions.

The WCAG 2.2 guidelines are divided into three conformance levels: A (lowest), AA, and AAA (highest). The AA level is often considered the essential standard for accessibility and is typically the benchmark most companies aim to meet.
